The Russian government has made changes to the rules of medical and social examination (MSE) to determine cases when disability is established indefinitely at the initial application, and when disability can be established during an absentee examination. A list of diseases, conditions and disorders compiled for this purpose is published on the Cabinet of Ministers website.

The published annex to the rules for recognizing a disabled person contains lists of diseases, defects, irreversible morphological changes,
violations of the functions of organs and systems of the body, in which permanent disability is established 1) during the initial examination; 2) no later than two years after it; 3) during an examination in absentia, as well as indications and conditions for establishing the category of “disabled child” for a period of 5 years and until the age of 14 years.

“The innovations in the rules also concern the possibility of making changes to the individual program of rehabilitation or habilitation of a disabled person without revising the disability group or the period for which it is established,” the government said.

“Firstly, the list of diseases and changes that occur in the body has been expanded, where already during the initial examination it will be possible to establish disability indefinitely and even in absentia,” the Prime Minister of the Russian Federation said at a meeting with deputy prime ministers Dmitry Medvedev.

“And secondly, if it is necessary to examine people in serious condition, their residence in remote and hard-to-reach places will be taken into account. This also makes it possible to conduct an examination in absentia. There are some other changes as well."

“The resolution provides for the possibility of establishing disability indefinitely for a whole list of diseases,” explained Deputy Prime Minister Olga Golodets. — This list includes for the first time all chromosomal abnormalities, including Down syndrome, liver cirrhosis, blindness, deafness, and cerebral palsy.

The procedure for establishing disability has been simplified for such types of diseases as scoliosis, malformations of the maxillofacial region, autism and a number of diseases that, unfortunately, children are now increasingly suffering from: diabetes mellitus and a number of other diseases.”

“This resolution concerns almost all disabled people, that’s 12 million people, of which 651 thousand are children,” the Deputy Prime Minister recalled.

“Based on the adjusted list, ITU specialists will be able to establish disability already during the initial examination without specifying the period for re-examination, in absentia or the category of “disabled child” before the citizen reaches the age of 18. Thus, the possibility of determining the period for establishing disability at the discretion of an ITU specialist will be excluded,” said the Cabinet of Ministers experts.

“A list of goals for conducting ITU has been defined that can be indicated in an application for its conduct. The introduction of this norm will give a citizen the right to contact the ITU bureau independently when, for various reasons, he does not have a referral to an ITU, as well as to resolve a specific issue without mandatory re-examination, including to make changes to the individual program of rehabilitation or habilitation of a disabled person.” , noted the developers of the new rules.

The list of diseases is not exhaustive. Only the most common ailments were included in the list. First group

Let's consider the criteria for establishing and the list of diseases for obtaining permanent disability. List of diseases that give the first, often permanent, disability:

  1. Paralysis of motor organs.
  2. Deafness.
  3. Blindness.
  4. Blind deafness.
  5. Complex, irreversible nervous disorders.
  6. Deformation of limbs, their absence.
  7. Insurmountable dysfunction of internal systems.

On a note! A disabled person of the first category is an applicant who cannot do without the help of third parties. There is a violation of his ability to work and the ability to provide for himself independently.

Second category

To establish, all diseases from the above list are taken into account. But here the commission focuses on the severity of the illness, the degree of negative consequences for the citizen. Belonging to this category is determined by the following factors:

  • opportunity to study/work below 80%;
  • the need for constant medical support;
  • no chance of quick rehabilitation.

Attention! A disabled person of the second category is exempt from compulsory employment. The state pays his maintenance.

  • loss of hearing and vision up to 80% and below;
  • persistent dysfunction of individual organs and systems;
  • renal, heart failure;

In the standard case, a disabled person is assigned an annual medical examination. In its course, the very status and belonging to one or another group is confirmed. If during treatment or rehabilitation the patient’s condition has improved, another group may be assigned. If functions are restored during the recovery period, the status is removed.

Third group

Considered the easiest. It is assigned to applicants in the event of a violation of a vital function, and not in conditions of its absence. For example, there are vision problems, but the applicant can see, read, process material, but his function of perceiving the external environment is slightly reduced; this is the third group.

List of diseases for third group disability in 2019:

  • instability of the motor system, given bone paralysis;
  • malignant tumor at the initial stage of development;
  • complex form of diabetes;
  • defects of the skull, jaw, facial region;
  • complete blindness of one eye;
  • visual impairment;
  • deafness;
  • amputation of fingers, hands, limbs;
  • implants in the cardiac region;
  • absence of one of the paired organs, including kidneys/lungs.

On a note! All diseases that determine membership in the third group, but are expressed in a more severe form, are the basis for assigning the first or second category.

Child disability in 2019

If the health condition of a minor prevents him from growing and developing, studying and playing sports, or interacting with society, then he may be referred for a medical and social examination. He will either be assigned a status and given an IPR, or given recommendations for treatment and recovery.

Diseases that in 2019 may become the basis for assigning a minor to a preferential category:

  • mental retardation;
  • mental retardation;
  • delay in physical growth and development;
  • impairment of visual and auditory function;
  • disruptions in the functioning of the endocrine system;

When disability is established for a year and indefinitely

In a standard situation, special status is assigned for a period of one year. An annual commission is appointed to check:

  • whether membership in a particular group has been preserved;
  • whether the grounds for special status remain.

If during rehabilitation the patient regains health and improves it, then the disability can be canceled or assigned a lighter category.

On a note! Children are a special category who, in the presence of deviations, defects, and persistent impairments, receive the status of “disabled child.” It remains with them until they reach adulthood. Before this period, they are not required to undergo any examination; they will be able to take it in absentia.

Standard order:

  1. Contact your doctor for examination, identification and confirmation of the disease.
  2. Receiving a referral to a commission.
  3. Collection of documentation.
  4. Contact the MSEC Bureau with a corresponding application.
  5. Passing the inspection.
  6. Obtaining a certificate/refusal confirming your special status.
  7. Appealing the commission's decision to higher authorities if the refusal is unlawful.
  8. Passing the examination a year later according to the same scheme.

But the law also provides for rules for establishing permanent and absentee disability. The first case provides for lifelong assignment of preferential status to the applicant. The second option is the possibility of confirming disability without a personal visit to the authorized body.

Permanent disability

The law allows the definition of permanent disability in 2019. This is done based on the presence of a new expanded list of diseases. But the deviation itself, the dysfunction, is not enough to obtain lifelong status. Additional circumstances are required

An indefinite disability group is established in the following cases:

  1. The patient experiences irreversible consequences.
  2. The diagnosis and group have been confirmed for more than 10 years in a row.
  3. There are persistent diseases or disorders that provide grounds for lifelong status:
  • amputation of limbs and other vital joints;
  • dementia;
  • degenerative irreversible conditions of the main brain;
  • deformation of the limbs without the possibility of correction;
  • chromosomal pathologies, including Down syndrome;
  • pathologies of a progressive type;
  • cerebral paralysis;
  • cirrhosis of the liver;
  • complete blindness;
  • deafness;
  • schizophrenia.

The regulation of the new sample rules allows you to immediately assign lifelong status. It is determined by who will be diagnosed with a disease at the first MSEC, which gives the right to permanent disability. Until 2018, it was necessary to undergo at least two examinations. The same regulations also allow for absentee examination.

Sometimes a lot of events happen in a person's life that can affect their health. Diseases can be of various types; some, after being on sick leave, can be cured with medication and go back to work, but because of other ailments, you have to register for disability and forget about working for several years or for the rest of your life.

Thus, according to the list, upon initial application, permanent disability for adults or children under 18 years of age will be established in the presence of the following diseases and conditions:

  1. Chronic kidney disease stage V in the presence of contraindications to kidney transplantation.
  2. Liver cirrhosis with hepatosplenomegaly and grade III portal hypertension.
  3. Congenital incomplete (imperfect) osteogenesis.
  4. Hereditary metabolic disorders, uncompensated by pathogenetic treatment, having a progressive severe course, leading to pronounced and significantly impaired body functions (cystic fibrosis, severe forms of acidemia or aciduria, glutaric aciduria, galactosemia, leucinosis, Fabry disease, Gaucher disease, Niemann-Pick disease, mucopolysaccharidosis , cofactor form of phenylketonuria in children (phenylketonuria types II and III) and others).
  5. Hereditary metabolic disorders that have a progressive, severe course, leading to pronounced and significantly impaired body functions (Tay-Sachs disease, Krabbe disease and others).
  6. Juvenile arthritis with severe and significant disturbances of skeletal and movement-related (static-dynamic) functions, the blood system and the immune system.
  7. Systemic lupus erythematosus, a severe course with a high degree of activity, rapid progression, a tendency to generalization and involvement of internal organs in the process with persistent, significant impairment of body functions, without the effect of treatment using modern methods.
  8. Systemic sclerosis: diffuse form, severe course with a high degree of activity, rapid progression, tendency to generalization and involvement of internal organs in the process with persistent, significant impairment of body functions, without effect from treatment using modern methods.
  9. Dermatopolymyositis: severe course with a high degree of activity, rapid progression, tendency to generalization and involvement of internal organs in the process with persistent, significant impairment of body functions, without the effect of treatment using modern methods.
  10. Individual disorders involving the immune mechanism with a severe course, recurrent infections and oslonia, severe syndromes of immune dysregulation, requiring constant (lifelong) replacement and (or) immunomodulatory therapy.
  11. Congenital epidermolysis bullosa, severe form.
  12. Congenital defects of various organs and systems of the child’s body, for which only palliative correction of the defect is possible.
  13. Congenital anomalies of the development of the spine and spinal cord, leading to persistent, pronounced and significantly impaired neuromuscular, skeletal and movement-related (static-dynamic) functions and (or) dysfunction of the pelvic organs, when surgical treatment is impossible or ineffective.
  14. Congenital anomalies (defects), deformations, chromosomal and genetic diseases (syndromes) with a progressive course or unfavorable prognosis, leading to persistent, pronounced and significantly impaired body functions, including mental dysfunction to the level of moderate, severe and profound mental retardation. Complete trisomy 21 (Down syndrome) in children, as well as other autosomal numerical and unbalanced structural chromosomal abnormalities.
  15. Schizophrenia (various forms), including the childhood form of schizophrenia, leading to severe and significantly impaired mental functions.
  16. Epilepsy is idiopathic, symptomatic, leading to severe and significantly impaired mental functions and (or) resistant attacks to therapy.
  17. Organic diseases of the brain of various origins, leading to persistent, pronounced and significantly impaired mental, linguistic and speech functions.
  18. Cerebral palsy with persistent severe and significant impairment of neuromuscular, skeletal and movement-related (static-dynamic) functions, mental, language and speech functions. Age and social skills are lacking.
  19. Pathological conditions of the body caused by blood clotting disorders (hypoprothrombinemia, hereditary deficiency of factor VII (stable), Stewart-Prower syndrome, von Willebrand disease, hereditary deficiency of factor IX, hereditary deficiency of factor VIII, hereditary deficiency of factor XI with persistent severe, significantly impaired blood function and/or immune system).
  20. HIV infection, stage of secondary diseases (stage 4B, 4B), terminal 5th stage.
  21. Hereditary progressive neuromuscular diseases (pseudohypertrophic Duchenne muscular dystrophy, Werdnig-Hoffmann spinal amyotrophy) and other forms of hereditary rapidly progressive neuromuscular diseases.
  22. Complete blindness in both eyes if treatment is ineffective; a decrease in visual acuity in both eyes and in the better-seeing eye up to 0.04 with correction or a concentric narrowing of the visual field in both eyes up to 10 degrees as a result of persistent and irreversible changes.
  23. Complete deaf-blindness.
  24. Bilateral sensorineural hearing loss of III-IV degree, deafness.
  25. Congenital arthrogryposis multiplex.
  26. Paired amputation of the hip joint area.
  27. Ankylosing spondylitis with persistent, significant impairment of body functions.

A list of diseases and conditions for which disability can be established during an absentee examination is also presented - it contains 14 points.

  1. Diseases of the respiratory system with significant impairment of the functions of the respiratory system, characterized by a severe course with chronic respiratory failure of the third degree; chronic pulmonary heart failure stage IIB, III.
  2. Diseases of the circulatory system with significant impairment of the functions of the cardiovascular system: angina pectoris of functional class IV - severe, significantly pronounced degree of impairment of coronary circulation (occurring in combination with chronic heart failure up to stage III inclusive).
  3. Diseases characterized by high blood pressure with severe complications from the central nervous system (with persistent severe disturbances of neuromuscular, skeletal and movement-related (statodynamic) functions, language and speech, sensory (vision) functions, dysfunctions of the cardiovascular system (accompanied by insufficiency blood circulation IIB -III degree and coronary insufficiency of III-IV functional class), with chronic renal failure (chronic kidney disease stages 2-3).
  4. Diseases of the nervous system with a chronic progressive course, including neurodegenerative diseases of the brain (parkinsonism plus), with persistent severe impairments of neuromuscular, skeletal and movement-related (static-dynamic) functions, language and speech, sensory (vision) functions.
  5. Extrapyramidal and other movement disorders with persistent significant impairment of neuromuscular, skeletal and movement-related (static-dynamic) functions, mental, language and speech functions.
  6. Cerebrovascular diseases with persistent significant impairment of neuromuscular, skeletal and movement-related (static-dynamic) functions, mental, sensory (vision), language and speech functions.
  7. Diabetes mellitus with significant multiple dysfunctions of organs and systems of the body (with chronic arterial insufficiency of stage IV in both lower extremities with the development of gangrene with the need for high amputation of both extremities and the impossibility of restoring blood flow and performing prosthetics).
  8. Unremovable fecal and urinary fistulas, stomas - with ileostomy, colostomy, artificial anus, artificial urinary tract.
  9. Malignant neoplasms (with metastases and relapses after radical treatment; metastases without an identified primary focus when treatment is ineffective; severe general condition after palliative treatment; disease incurability).
  10. Malignant neoplasms of lymphoid, hematopoietic and related tissues with severe symptoms of intoxication and severe general condition.
  11. Inoperable benign neoplasms of the brain and spinal cord with persistent pronounced and significantly severe impairments of neuromuscular, skeletal and movement-related (statodynamic) functions, mental, sensory (vision), language and speech functions, severe liquorodynamic disorders.
  12. Congenital epidermolysis bullosa, generalized moderate-severe, severe forms (simple epidermolysis bullosa, borderline epidermolysis bullosa, dystrophic epidermolysis bullosa, Kindler syndrome).
  13. Severe forms of psoriasis with persistent, significant impairment of body functions, not controlled by immunosuppressive drugs.
  14. Congenital forms of ichthyosis and ichthyosis-associated syndromes with pronounced, significantly impaired function of the skin and related systems.

In April 2019, the Government of the Russian Federation adopted a list of diseases confirming this diagnosis and made amendments to the rehabilitation program. It is very difficult to compile a complete list of diseases that give the right to incapacity, everything is individual. Disability is assigned indefinitely, in absentia and upon reaching adulthood. Amendments for 2019-2019 included new deviations in the functioning of the body, Down syndrome, schizophrenia, liver disease, blindness, deafness, and cerebral palsy. In total, there are 58 ailments on the list.

A disabled citizen is unable to work fully due to the fact that there are disorders in the body. Diseases for registration of exemption in 2019-2019 are established by a special board; it carefully studies the status of the patient and his social status, as well as statements from the attending physician at the place of registration. A referral to the commission must also be obtained from the attending physician, and all necessary extracts and opinions from specialists must be completed. A medical and social expert commission studies all the information on each specific case and, by voting, issues a conclusion on the person’s registration. If the data is insufficient, additional examinations are ordered; if a person applying for disabled status refuses to undergo them, the commission makes a verdict based on the available facts.

Disability in 2019-2019 is divided into group 1 (for up to two years), groups 2 and 3 (for a year), childhood disability is usually established before adulthood or up to two years, depending on the degree of the disease. In cases where the patient cannot attend the commission in person, it goes to the home.

After the commission assigns the right to receive disability due to a problem of the body, the patient or his guardian will be issued a document of the established form that has full legal force. With the received certificate, the patient or legal representative must appear at the territorial Department of Social Protection at their place of residence and apply for subsidies.
